Motor Traffic Act Effective 01.07.2009.

 

Here are some important changes that have been made to the existing Motor Traffic Act wef 1/7/2009. Certain very  changes are stated below and are very important in the case of reporting an accident to the Authorities:

  • As per section 161 (51) (a) of the Motor Traffic Act, it is a requirement that the driver should report an accident to the nearest police station.
  • If a driver fails to report such accident forthwith to the officer in charge of the nearest police station, he/she shall on conviction be liable to a fine not less than Rs.3,000/- and not exceeding Rs. 5,000/-.   Therefore, it is mandatory for all the accidents to be reported to the nearest police station by the driver.
  • At the same time, section 161 (51) (b) states that the, Insurer shall inform the officer in charge of the nearest police station of such accidents with details regarding the accident, names and addresses of the parties involved in the accident with brief description of the accident.
  • If the Insurer fails to inform such an accident,they are liable to a fine not less than Rs.5,000/- and not exceeding Rs.10,000/-
  • In view of this, please ensure to advise all your kids,wife’s,husbands, employees,drivers of these two important amendments which are now in operation.
